Terms of Service
These terms govern your use of Captain Hook (“we”, “us”), a digital loyalty platform. By creating an account or using the service you agree to them on behalf of your business.
1. The service
Captain Hook lets businesses run a branded digital loyalty programme: customer check-in by QR code, digital stamp cards and rewards, a staff app for issuing stamps, analytics, and email campaigns to customers who have opted in. The merchant dashboard is at captainhook.co.
2. Who can use it
The service is for businesses. You must be at least 18 and authorised to accept these terms for the business you register. You are responsible for the accuracy of your account details and for keeping your password, staff accounts and activated devices secure. Activity under your account and your staff accounts is your responsibility.
3. Free trial
New accounts start with a free trial of the Solo plan. No payment details are needed to start it. When the trial ends, access to your dashboard is paused until you subscribe. Your customers can keep checking in and earning stamps for 7 more days; after that your loyalty programme goes offline until you subscribe.
4. Plans, prices and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle’s Buyer Terms.
Paid plans are subscriptions billed monthly or yearly in advance. The price, including any applicable taxes, is shown before you pay. A subscription renews automatically at the end of each billing period until you cancel it.
If you change plans, the change and any credit or extra charge are calculated by Paddle and shown to you before you confirm. We may change our prices; a new price applies from your next renewal after we have told you about it.
5. Cancellation and refunds
You can cancel at any time from the Billing page in your dashboard. Cancellation stops the next renewal; your plan stays active until the end of the period you have paid for. After that, your customers can keep checking in for 7 more days, then your programme goes offline. Refunds are covered by our Refund Policy.
6. Your customers and their data
Through the service you collect information about your own customers, such as phone number, name, email address, birthday and visit history. You are responsible for having a lawful basis to collect and use it, for telling your customers how you use it, and for only sending marketing to customers who have agreed to receive it. We process that information on your behalf and on your instructions, as described in our Privacy Policy. Every campaign email carries an unsubscribe link, and we honour it.
7. Acceptable use
You agree not to:
- use the service for anything unlawful, deceptive or harmful, or to send spam or unsolicited messages;
- upload content you do not have the right to use, or that is offensive or infringing;
- try to access accounts, data or systems that are not yours, or disrupt, probe or overload the service;
- copy, resell or reverse-engineer the service, or use it to build a competing product.
8. Your content and our platform
You keep ownership of your logo, branding, reward details and campaign content. You give us permission to host, display and send that content only as needed to run the service for you. The platform itself — software, design and trademarks — belongs to us, and these terms do not give you any rights to it beyond using the service.
9. Availability and changes
We work to keep the service available and secure, but it may occasionally be interrupted for maintenance or reasons outside our control. We may improve or change features over time. If we make a change that materially reduces what your plan includes, we will tell you in advance.
10. Suspension and closing your account
We may suspend or close an account that breaches these terms or puts the service or other users at risk, and will tell you why where we can. You can ask us to close your account at any time by emailing [email protected]. After an account is closed we delete or anonymise its data within 90 days, unless the law requires us to keep it longer.
11. Disclaimers and liability
The service is provided “as is”. To the extent the law allows, we do not guarantee that it will be uninterrupted or error-free, and we are not liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim relating to the service is limited to the fees you paid for it in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is significant we will notify you by email or in the dashboard before it takes effect; continuing to use the service after that means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Hashemite Kingdom of Jordan, and the courts of Amman have jurisdiction over any dispute, except where the law of your country gives you a right to bring a claim elsewhere.
